Terms and Conditions

These Terms and Conditions (“Terms”) govern the rental, sale, deployment, and use of mobile surveillance trailers and related services (“Systems”) provided by BFC Secure (“BFC,” “we,” or “us”). By renting, purchasing, or using BFC Secure Systems, the customer (“Customer” or “Renter”) agrees to these Terms.
1. Scope of Services
BFC Secure provides mobile surveillance solutions through rental and sale arrangements, including short-term and long-term deployments.
Rental services are provided as an integrated security deterrence and monitoring service, which may include equipment, cellular communications, system health monitoring, video monitoring, power management, and support services, as defined in the applicable proposal, invoice, or written agreement.
Unless expressly stated in writing:
BFC Secure does not provide on-site security personnel
BFC Secure does not provide law enforcement services
BFC Secure does not guarantee prevention of theft, vandalism, trespass, bodily injury, or other criminal or harmful activity
All services are risk-mitigation tools, not guarantees of outcome.
2. Rental and Sales Structure
2.1 Rental Services
Rentals may be structured as short-term or long-term deployments.
Pricing, minimum rental terms, and applicable fees are defined in the customer’s proposal or agreement.
Rental periods begin on the date the System is delivered to the site or activated, whichever occurs first.
Rental services are provided as a security service, not merely an equipment lease.
BFC Secure retains ownership of all rental equipment at all times.
2.2 Sales Transactions
Equipment sales are offered as outright purchases unless otherwise stated in writing.
Title to sold equipment transfers to the customer only upon receipt of full payment.
Monitoring, communications, or support services are not included with sales unless covered by a separate written agreement.
3. Pricing, Fees, & Payment Terms
Rental fees are billed in advance unless otherwise stated in writing.
Sales invoices are due per the payment terms listed on the invoice.
One-time fees may apply, including but not limited to:
Mobilization and delivery
Setup and configuration
Relocation or redeployment
Removal or demobilization
Early termination
Late or unpaid invoices may result in service suspension or removal of rental equipment without liability to BFC Secure.
4. Monitoring & Communications Services (Rentals)
For rental deployments, monitoring and communications services are included unless otherwise stated in writing.
These services may include:
Cellular data connectivity
System health and uptime monitoring
Power and battery management
GPS location services
Video monitoring and event review
BFC Secure does not warrant:
Uninterrupted connectivity
Continuous cellular service
Guaranteed response times
Guaranteed detection or deterrence outcomes
5. Service Availability & Downtime Credits
BFC Secure makes commercially reasonable efforts to maintain system functionality.
If rental equipment becomes non-operational due to equipment failure or service issues not caused by the Customer, BFC Secure may issue a prorated service credit based on full days of downtime, calculated against the monthly rental rate.
No credits will be issued for downtime caused by:
Site power loss or electrical issues
Cellular or third-party network outages
Weather or environmental conditions
Improper relocation or handling
Site hazards or unsafe placement
Third-party actions beyond BFC Secure’s control
6. Equipment Relocation & Handling
Customers may be authorized and trained to relocate rental equipment.
Before moving any trailer:
The mast must be fully lowered
Camera assemblies must be secured in transport position
The Customer is financially responsible for any damage resulting from relocation performed without following required procedures.
7. Active Deterrence & Safety Systems
Rental Systems may include active deterrence or self-protection features designed to discourage tampering or unauthorized access.
If the Customer requests that any safety or deterrence system be disabled:
BFC Secure assumes no responsibility for resulting damage
The Customer is responsible for all repair or replacement costs resulting from such disabling
8. Insurance & Risk Allocation
Rentals
BFC Secure maintains insurance coverage for rental equipment it owns.
The Customer is responsible for maintaining insurance coverage for:
Their property
Their site
Their operations
Any losses not directly attributable to BFC Secure equipment failure
Sales
Upon transfer of title, the Customer assumes full responsibility for insurance, risk of loss, and liability unless otherwise agreed in writing.
9. Equipment Damage, Loss, or Theft
Rental Equipment
BFC Secure is responsible for normal maintenance, repair, or replacement due to:
Ordinary use
Vandalism
Equipment failure not caused by the Customer
The Customer is financially responsible for damage, loss, or theft resulting from:
Improper relocation or handling
Failure to follow required procedures
Vehicle strikes or construction activity
Site hazards or unsafe placement
Tampering or unauthorized access by individuals under the Customer’s control
10. Limitation of Liability
To the maximum extent permitted by law:
BFC Secure is not liable for indirect, incidental, consequential, or special damages, including theft, property damage, business interruption, or bodily injury.
If liability is found under any circumstance, BFC Secure’s total aggregate liability is limited to three (3) months of rental fees for the affected System.
The Customer assumes responsibility for maintaining adequate insurance coverage for their risks.
11. Term & Early Termination
Rental terms are defined in the applicable agreement.
Early termination may result in an early termination or disposal fee equal to the remaining unpaid rental fees for the agreed-upon term, unless otherwise stated in writing.
12. Governing Law
These Terms are governed by the laws of the state in which BFC Secure is headquartered, without regard to conflict-of-law principles.
